Legal Matters related to international students

Despite your status as an international student, you can sue and be sued in a civil court of justice. The legal proceedings will develop according to state or federal law, depending on the alleged felony, the court where the complaint was filed or where the arrest warrant originated.

Criminal Activity

A student involved in criminal activity, puts his/her visa status in jeopardy. The United States Judicial System treats U.S. citizens and nonimmigrants equally. Therefore, you have the same
right to an attorney and to have your rights explained in case of arrest -Miranda rights. You are also protected from unlawful search and seizure. Some of these general rights conflict at times with some I.N.S. mandates.

In case of arrest, the student should notify the College of the incident and proceed to hire an attorney.

If the felony is also considered a violation to the Honor Code or other regulations enforced by the College, the Dean of Students will proceed in accordance with College procedures and policies.
The ISO will participate in the procedure, if deemed necessary.

If the felony is not considered a violation to the Honor Code, the College will observe the proceeding and make the necessary adjustments to comply with court mandates.
